New Executive Orders on Law Enforcement and Sanctuary Jurisdictions

Good morning,

It was wonderful to connect with many of you in DC at the IMLA Seminar!  I wanted to alert you all to two new Executive Orders that were issued last night that are relevant to local governments.  I suggest you read both in full as they are short and have a few moving parts to them.  Both provide for the potential criminal punishment of state and local officials.

  1. Strengthening and Unleashing America's Law Enforcement to Pursue Criminals and Protect Innocent Citizens.  https://www.whitehouse.gov/presidential-actions/2025/04/strengthening-and-unleashing-americas-law-enforcement-to-pursue-criminals-and-protect-innocent-citizens/.  There are a few facets to this order.  It provides for the creation of a legal resources and indemnification for law enforcement officers and notes that the mechanism will include the use of private pro bono assistance for law enforcement officers (presumably from some of the big law firms that signed deals with the President).  It also seeks to empower law enforcement in various ways (including the review and potential rescission of consent decrees) and provides that the AG and Secretary of Defense need to determine how the military and national security assets will be provided to local jurisdiction to assist in state and local law enforcement. And finally, it seeks to hold state and local officials accountable if they "willfully and unlawfully direct obstruction of criminal law, including by directly and unlawfully prohibiting law enforcement officers from carrying out duties necessary for public safety and law enforcement;" or unlawfully engage in discrimination "under the guise of" DEI that "restrict law enforcement activity or endanger citizens."

  2. Protecting American Communities from Criminal Aliens. https://www.whitehouse.gov/presidential-actions/2025/04/protecting-american-communities-from-criminal-aliens/.  This order directs that within 30 days, the AG and Secretary of Homeland Security shall publish a list of state and local jurisdictions that "obstruct the enforcement of Federal immigration law (sanctuary jurisdictions)"  And that after the publication of that list, the AG and Secretary will notify each sanctuary jurisdiction of its defiance of federal immigration law and any potential violations of criminal law.  The order also directs the head of each agency to identify appropriate federal funds to suspend and terminate including grants and contracts for any such sanctuary jurisdictions.  The order also directs the AG and Secretary to identify and take action to stop the enforcement of any state or local laws that "favor aliens over any groups of American citizens...including State laws that provide in-State higher education tuition to aliens but not to out-of-State American citizens."
