42 PaCSA 5903 sets forth the meager fees and expenses that must be provided to subpoenaed witnesses. Some local municipal police departments issue a form letter to attorneys issuing subpoenas, stating that there is a witness fee of $300.00 (or some similar number) for police officer testimony in civil cases. More often than not, it goes unchallenged. If an officer is being asked for his opinion about anything and is acting as an expert, then he or she can negotiate that fee. But outside of that, is there something I am not aware of that allows these letters to be routinely issued in the face of the statutory five dollars plus mileage per day? I often help out the officers by sussing out whether their testimony is really needed, or scheduling the deposition at the station at the end of a shift, but I have never demanded additional money when there is no expert testimony involved. Any input appreciated.
