7th Circuit - Takings - Riparian Rights
So, if the government shoots down a Chinese balloon having the size of a supermarket and the debris lands on your property, do you have a takings claim? Well, who knows, but things seem to be getting interesting on that score and we do know that in the 7th Circuit if the government removes a dam and a property owner gets ticked off that what was once a pretty nice waterfront and is now more land and less waterfront, doesn't have a takings claim. The gist is this - dam created a lake of sorts that covered some 15 feet of the property owner's land and now rather than water, the land is exposed. So, the property owner sues for a taking. I've got to admit that I've seen the reverse and courts seem to hold that the increased water coverage is a taking, but now we know that once the fluid has been removed - no taking.
