Hot off the presses is an en banc decision of the Commonwealth Court, reversing prior authority and concluding that, under the circumstances, Indiana University is not subject to taxation of realty owned and leased commercially.
This decision could certainly affect municipalities which host State System institutions. As an en banc decision, a motion to reconsider is either barred or is less likely. Our guess is that the there’s going to be a petition for allowance of appeal (allocator).
