TWL: A Life and Death Question

Greetings All:

Kelly and I are in the final stages of preparation for our great trek
across the country.

We are dotting the I's and crossing the T's so to speak. We will be
leaving for Anacortes to pick up our boat in about 3 weeks, and will be
making our way east for the next 2-3 months. This trek will take us up
the Columbia/Snake Rivers, a truck to Sturgeon Bay Wisconsin, then
either a cruise across the Great Lakes/Erie Canal/Hudson River, or down
the Mississippi, Gulf, and up the east coast; all in all a long trip.

As part of the preparation, we are drawing up our living wills and
health care proxies. In doing so, we have run into what seems to be a
real problem. Health care proxies and living wills are "state-specific".
In other words, what is legal and procedural here in NY, is not in other
parts of the country.

How do people who live and cruise most of the time deal with this
important issue?? I would hate to be faced with a disaster somewhere,
and find that Kelly's or my health care wishes will not be honored
because the paperwork was drawn up in another state, or because our
wishes are not "recognised" in a particular state.

I am not an expert but I think that the laws in your state of RESIDENCE
would apply. Simply traveling though a state would not subject you to
their laws.

Believe me when I tell you that some state will decide that it is your
state of residence, even if you do not do so. The best course of action is
to make the decision yourself, based on a number of considerations such as
taxes. The issue may not present itself until you die, or until some state
decides you haven't paid them income tax, or any other number of ways.

Talk with your attorney and get his advice before your widow/family gets to
deal with the issue!

I don't want to post my little primers about residency again, for fear of
boring all the list old timers. Anyone who wants to take a look can go to
