I am posting this email to the list to make sure it is working properly, so please let me know if you receive this email. As an example of issues that the list can be used for I am passing along information about recent SEC enforcement actions:
Two SEC actions have been finalized according to Bond Buyer relating to Harvey, IL and Allen Park, MI and their officials. . One is pursuant to a judicial injunction, and the other is an administrative action involving a Commission cease and desist order and financial penalty. Both bar municipal officials from participation in future bond issues. These are firsts and reflect the Commission's intention to focus on individual penalties. Coincidentally, IMLA is filing an amicus brief to support the budget officer of Miami who was assessed a civil penalty by the SEC. IMLA is supporting the position that municipal officials should be entitled to qualified immunity for civil penalties just as they are for civil damages.
These actions reflect increased enforcement activity by the SEC in the municipal bond market and suggest that local attorneys must be vigilant regarding their clients' disclosures both at issuance and for the life of the bonds.
