As attorneys representing cities and counties associated with
universities and colleges, you may be interested in becoming familiar
with a case involving my city, the City of Gainesville, Florida.  The
Plaintiffs (landlords) challenged the City's regulatory landlord tenant
ordinance on a number of grounds.  After reviewing the evidence and oral
argument, the trial court upheld the city's ordinance as constitutional.
The Plaintiffs appealed the case to the first district court of appeal.
Oral argument will be held on Thursday, February 19, 2009 and you can
view same on your desk top computer by going to the following website:

Kevin Daly and Carol Daly v. City of Gainesville, Case No. 1D08-2923 -
Oral Argument set for February 19, 2009 at 2:00p.m. can be viewed live
at http://www.1dca.org/video.html http://www.1dca.org/video.html  by
clicking on "Oral Argument Video".  (NOTE: there are several cases
scheduled for oral argument at this time slot, so this case may not be
the first one heard by the court - you may want to check the docket the
day before oral argument to determine when the case will be scheduled in
the afternoon portion)

Additionally, I have attached the briefs so that you can familiarize
yourselves with the issues and applicable law.

This is also a reminder that the University Cities Committee will meet
in a roundtable setting at the IMLA Mid-Year meeting in Washington, D.C.
on Sunday, April 19 at 10:30 a.m.-12:00 p.m.  Please plan to join us and
share your concerns with your fellow local government attorneys.  If you
can attend, please reply so that we can determine the number of
participants who will be present.

Thank you.
