Sometimes in the course of human events an unreported case can prove helpful and enlightening.  Today the 2nd Circuit decided an employment law case raising issues of ADA and ADEA claims that the court concluded where properly dismissed for not having stated a viable claim and upheld the lower court's decision not to allow the amended complaint (for the same reason).  I believer the court laid out clearly the law on what an employee must do to engage the employer in a discussion of reasonable accommodation.  The court also discusses retaliation, and a claim that the decision to terminate involved the projected high medical expenses for a dependent who had cancer.  In each the court found the complaint lacking in sufficient facts to substantiate a viable claim.  https://www.ca2.uscourts.gov/decisions/isysquery/631fc812-da78-4956-944f-7b164a1556d9/2/doc/20-2044_so.pdf#xml=https://www.ca2.uscourts.gov/decisions/isysquery/631fc812-da78-4956-944f-7b164a1556d9/2/hilite/ DOLAC vs. ERIE COUNTY SHERIFF'S DEPT.
