For the International Municipal Lawyer's Association - IMLA's 5 things to know for January 15th
Today we honor Doctor King on the anniversary of his birth, but it is the words he gave us on August 28, 1963 that will forever inspire us. As someone who remembers segregation, those words inspired me then and they continue to. Let his words remind us of what we can be, listen to them and let me repeat just a few "We cannot be satisfied as long as the Negro in Mississippi cannot vote and the Negro in New York believes he has nothing for which to vote. No, no, we are not satisfied, and we will not be satisfied until justice rolls down like waters and righteousness like a mighty stream." "I have a dream that one day this nation will rise up, live out the true meaning of its creed: "we hold these truths to be self-evident, that all men are created equal." I have a dream that one day on the red hills of Georgia sons of former slaves and sons of former slave-owners will be able to sit down together at the table of brotherhood. . . . I have a dream that my four little children will one day live in a nation where they will not be judged by the color of their skin but by the content of their character." Dr. King's words invigorated the Civil Rights movement and animated Americans. Let us not forget where we were and where we need to be. Let us not forget that discrimination comes in all shapes, sizes and formats. Remember his oration "When we allow freedom to ring-when we let it ring from every city and every hamlet, from every state and every city, we will be able to speed up that day when all of God's children, black men and white men, Jews and Gentiles, Protestants and Catholics, will be able to join hands and sing in the words of the old Negro spiritual, "Free at last, Free at last, Great God almighty, We are free at last." Today in Dr. King's memory, let me add for our friends everywhere in all branches of government, that there are others regardless of their faith, their sexual orientation, their ethnicity or their country of origin with whom we must join hands if we are to be free. Join me in remembering Dr. King today.
On Friday the Supreme Court granted certiorari in South Dakota v. Wayfair where the issue is whether the Supreme Court should abrogate Quill Corp. v. North Dakota's sales-tax-only, physical-presence requirement. Tom Goldstein who is one of the counsel to petitioners will be speaking at our Seminar in April.

On scotusblog, on Friday the authors listed Loudon County vs. Dulles Duty Free as a petition of the day. The case seeks clarity in the import-export clause of the constitution and to allow non-discriminatory local taxes to apply to the business located in that county. IMLA has agreed to file an amicus brief in support of Loudon County's petition.

Speaking of Loudon County, IMLA recently filed briefs in two important cases originating from Loudon County that involve the question of whether public officials can block users of social media from their privately established accounts. In one case the court ruled in favor of the local officials and in the other against the official. The same plaintiff is in both.

Code enforcement can be tricky and administrative searches involve a combination of issues associated with when a warrant is required. A federal judge recently ruled Atlanta violated the Constitution when conducting administrative searches. IMLA will support Atlanta and the case is a good reminder to check your policies. IMLA's code enforcement section presents programming on administrative searches and we have materials available to members.
