For those of you who may be unhappy with the NFL ticket policies, this case is for you and has virtually nothing to do with local government law. The 3rd Circuit today found that an individual representative a potential class has standing to bring a claim involving a NJ law that required a person controlling ticket sales to withhold no more than 5% from the general public. The Plaintiff asserts that for Super Bowl XLVIII only 1% were made available to the general public. The 3rd Circuit while finding the plaintiff had standing reserved direction on what to do until a certified question to the NJ Supreme Court was answered. Depending on the answer to that question, one might ask whether the NY Giants/Jets wouldn't like to move their stadium back across the river.
