I'm looking for any recent ordinances or administrative regulations that regulate shared transportation devices - e-scooters, e-bikes, bike share programs, etc. Any examples would be most appreciated!  I have seen the $1 to Start article published in IMLA last fall.

Good Morning,

I've attached IMLA's Guidance on Dockless Micromobility in the hopes that it will help. I'm working on an updated version to include liability problems and other issues not covered in the attached document. If anyone has questions on those topics in the meantime, please contact me directly. As for specific examples, I suggest looking at the following ordinances/regulatory programs I've read through: Austin, Santa Monica, Portland (pilot program), Providence, and Chicago (pilot program - stringent requirements).

I'll add that Austin passed an ordinance regulating rider behavior which you may find interesting: https://www.austintexas.gov/edims/document.cfm?id=320031; there's also this Rules for the Rights of Way document: https://austintexas.gov/sites/default/files/files/Transportation/Dockless_Final_Accepted_Searchable.pdf. Additionally, I know D.C. has been working on the enforcement problem, which will likely result in granting authority to their department of transportation (DDOT) and that will allow parking enforcement or other similar code enforcement groups to ticket bad actors.

I'll also point out that Providence does not allow scooters to be in operation when it is not light out. Operators are responsible for disabling their scooters during dark hours and the scooters may only be in operation from sun up to sun down. Atlanta followed suit in an effort to protect riders after four rider deaths this summer. Chicago's pilot program sets hours of operation from 5am to 10pm at which time the scooters must be removed from the streets. The scooters do not have reflective coating or stickers/decals, so it's hard for drivers to see them at night, especially in dimly or poorly lit areas.

I'm working on an updated version to include liability problems and other issues not covered in the attached document. As for specific examples, I suggest looking at the following ordinances/regulatory programs I've read through: Austin, Santa Monica, Portland (pilot program), Providence, and Chicago (pilot program - stringent requirements). I'll add that Austin passed an ordinance regulating rider behavior which you may find interesting: https://www.austintexas.gov/edims/document.cfm?id=320031; there's also this Rules for the Rights of Way document: https://austintexas.gov/sites/default/files/files/Transportation/Dockless_Final_Accepted_Searchable.pdf. Additionally, I know D.C. has been working on the enforcement problem, which will likely result in granting authority to their department of transportation (DDOT) and that will allow parking enforcement or other similar code enforcement groups to ticket bad actors. I'll also point out that Providence does not allow scooters to be in operation when it is not light out. Operators are responsible for disabling their scooters during dark hours and the scooters may only be in operation from sun up to sun down. Atlanta followed suit in an effort to protect riders after four rider deaths this summer. Chicago's pilot program sets hours of operation from 5am to 10pm at which time the scooters must be removed from the streets. The scooters do not have reflective coating or stickers/decals, so it's hard for drivers to see them at night, especially in dimly or poorly lit areas. Attached is what Fayetteville passed last month. Our state legislature enacted the "Electric Motorized Scooter Act" earlier this year so our hands were tied on some things like insurance, which has apparently been tough for all but the largest operators to obtain. Of course, Lime was the driving force behind out new state statute so it makes sense they would try to drive out the smaller competition.
