Who pays for what in a survey/sea trials

I thought I had a pretty good idea of how surveys worked. Having purchased
many boats, and had two surveys & sea trials just within the last two
months, who paid what seemed pretty standard.

Now, today, the broker for a boat we have a contract on informs me that it
is MY responsibility to locate and pay a captain to run the boat on sea
trials. I responded that, in my experience, the seller was responsible for
operating his own boat, or making arrangements for someone to operate it in
his stead. Most of the sea trials I have been on the owner ran his own boat,
but in several cases they opted for a professional captain.

What is the experience of the listees in this matter? Have any of you ever
had to pay a captain to run the sellers boat?

I would also be concerned about the liability of having someone run a boat I
did not own. I know professional captains are supposed to have insurance,
but what are the chances the owner could come back on me should something
happen to his boat while on sea trial?

I've never heard of that. I've seatrialed several boats to buy, and taken
prospective buyers on sea trials on boats I was selling, and never was asked
to use or provide a professional captain.

While you can be sued any time for anything, if you were on a seatrial
operating a prospective boat with the owner's permission, I doubt he would
have much recourse if something happened unless you were operating in a
negligent manner.
