I keep forgetting to look at my "university cities" folder where Outlook sends these emails, so sorry I missed the call. But I now have a question for the group:
We are proposing an amendment to our zoning code that allows "college fraternities/sororities" to qualify for special exception use, by adding that the fraternity/sorority "shall have an affiliation with the University of Michigan or another post-secondary college or university operating facilities within the city." We think this is a standard definition and is just clarification of what a "college fraternity/sorority" is.
We do not want the definition of eligibility for special exception use to be misapplied or applied broadly to any house full of college kids or other large group of residents, regardless of the zoning of the property.
However, we have been contacted by an attorney who claims the addition of this requirement is an unlawful delegation of authority to the university(ies), or discriminatory or unconstitutionally vague, though without explanation of the latter two claims. On the delegation, they claim is that we are giving unfettered authority to the university(ies) to set rules and definitions.
Has any of you dealt with this type of attack on your zoning code relative to fraternity and sorority houses? Was the attack successful? Were you successful?
Does any of you have a definition for fraternity/sorority houses-either for special exception use or other zoning purposes?
