IMLA 74th Annual Conference in Miami - Meeting of the University Cities/College Towns Working Group

REMINDER:
The University Cities/College Towns Working Group will be meeting on
Sunday morning, October 18, at 8:45 a.m. at the Hilton Miami Downtown
Hotel, Picasso Room.  I look forward to meeting each of you who have
communicated with each other during these past months on issues relating
to university cites and college towns.

As a City Attorney for many years of a large University, I can
appreciate the unique problems and challenges of a city or town that
sponsors an institution of higher learning.  I would ask each of you to
bring both your problems and your solutions to the problems facing your
city or town.  I will share with you the recent experience of the City
of Gainesville, Florida, addressing underage drinking.  After adopting
an ordinance, a lawsuit was filed seeking to have the ordinance declared
unconstitutional and unlawful on state grounds.  The trial court upheld
the city's ordinance with the exception of one minor provision.  The
plaintiff, bar owner, has appealed the decision to the appellate court
and briefs are now being prepared and filed.  Come to the meeting and I
will share copies of our ordinance and the order of the trial court.

Unfortunately, I will not be able to attend, but I would be very interested in various approaches used to restrain land-banking by a university and the consequent removal of university properties from the tax rolls.  I represent the City of Webster Groves, a suburb of St. Louis which houses Webster University.  WU has about 10,000 students, most of whom are commuters.  The campus has doubled in size during the past 20 years, and we have formulated an institutional zoning district and we have an uneasy understanding with WU that any property outside the district should remain on the tax rolls, but that could change at any time.  In Missouri, the collector of revenue for the county hears petitions for exemption from real estate taxes and the petitioner needs to show they are a bonified 501c3 corporation and that the primary use of the property is for a charitable purpose.
