I thought an unreported decision today by the 4th Circuit might give some of you a brief respite from the grind of defending attorneys fees claims. In Caraway v Elizabeth City, the Court concluded that the District Court was correct in granting Qualified Immunity to the officers who arrested a preacher for amplified preaching during the 2016 North Carolina Potato Festival (the "Festival") and also affirmed the award of attorneys fees to the officers and city for defending a frivolous facial challenge claim to the state law and city ordinance.
