How do you handle a situation where a judge disqualifies an attorney in the law department who is representing both the police and the local government in a 1983 action asserting a conflict? Further to the question, what if the officer wants the attorney to continue the representation? Any thoughts? (The local government indemnifies the officer and there appear to be no issues that would cause the government not to indemnify the officer so no reason to believe the two are at odds.)
