Scooter-Related Complaints

Dear University Cities List,

I've received complaints against Norfolk, VA and Bloomington, IN which I've attached. I've also updated the document I sent yesterday summarizing the scooter litigation IMLA knows of.

The complaints against Norfolk, of which there are three, were filed by Bird who challenges the RFP process under which they were not awarded a contract to operate their scooter business. I have the exhibits in the Norfolk complaint. The files are too big to send with this email, so if you would like to see the exhibits (which includes the RFP) please email me separately and I'll send them to you.

The complaint against Bloomington is a personal injury claim. The plaintiff alleges that an infrastructure defect in the sidewalk was the proximate cause of his injury and that the city should thus be held liable. My suggestion in the event you are hit with such a claim is to pay close attention to whether the city had notice of the defect in the roadway, and the timing between the notice and the accident. Lack of notice or lack of enough time to remediate the issue that was complained of is a valid argument to these types of allegations in other contexts (e.g. potholes in the road that damage to cars).
