Fire Escrow Funds

Fellow Solicitors:

RE:  Fire Escrow Funds (40 P.S. §638)

This process has existed for about twenty-five years.  It has resulted in property owners' insurance companies depositing funds with the City Treasurer, and in many cases, unfortunately forgotten.  Has anyone else run into this situation?  We are concerned about properties where the original owner is long gone and the funds remain in the Treasurer's Office.  The original owners who suffered the fire and had the insurance did not claim the proceeds because the structure was not repaired.  Later owners may have completed the repairs, but it is not their insurance company's money.

Municipalities do not have the power to escheat in Pennsylvania.  Experiences and ideas are welcome.
