In an unreported decision the 4th Circuit today spurned an effort by a former city employee who complained that her salary disparity was gender based discrimination.  Helpful to the city's case, apparently she had but one comparator a man who was paid much more but who the city said was paid more because he filled a job that had been vacant for some time and no one else seemed interested in it whereas the Plaintiff was hired into a job that was eagerly sought by many and the city was choosing between the Plaintiff and another person when they hired her so she had no leverage on salary.  Apparently, the disparity galled her and she frequently complained - which I gather irritated her boss.  She was demoted and left the job asserting her constructive discharge.
