All, I have been an IMLA member since 2010 and have practiced municipal law since graduation from Saint Louis University Law School in 1984, as a city prosecutor, city attorney, special counsel and court-appointed class counsel for Missouri municipalities. I currently serve as City Attorney for University City, Missouri, a constitutional charter city having a population of 35,000 in St. Louis County, Missouri. Washington University's main campus is mostly in an unincorporated St. Louis County area that borders University City; none is in University City. Washington University owns numerous apartment buildings and other properties in University City, and has a police department of state-certified police officers who have been deputized by St. Louis County and patrol in off-campus student housing areas in University City. In 2014, Washington University estimated that 2,840 of its students lived in University City, approximately half of whom lived in market-rate housing and the other half in Washington University housing.
The City Council established an advisory board in 2014 to examine Washington University's tax-exempt property in University City (under its 1853 state charter, essentially all property Washington University owns in Missouri is tax exempt) and make recommendations to the City Council on how to deal with the revenue shortfall caused by Washington University. The advisory board was also authorized to study the increased demand on University City resources and infrastructure over the next ten years, including public safety, public works, capital infrastructure improvements, parks, parking resources, revenue responsibility and quality of life issues. The advisory board submitted its report in 2015. The City Council is now interested in creating a joint task force with Washington University that may consider the 2015 report and will evaluate the fiscal impacts that Washington University has on University City and make recommendations for mitigation to the extent a study to be performed by an outside consultant determines that Washington University has a negative fiscal impact. Mitigation may include but is not limited to PILOTS and monetary or other contributions for various projects in University City. Washington University's endowment was $7.86 billion last year.
University City has numerous concerns or issues, including zoning, Property Maintenance Code enforcement, parking in residential neighborhoods, loud parties and other disturbances, nuisances, policing by Washington University in off-campus housing areas and the role of it police department and relationship with University City's, sharing or coordinating law enforcement resources including personnel and surveillance equipment, and any taxes or fees that may be lawfully imposed. I do not expect the task force to address all of these issues. I appreciate the opportunity to participate in this university cities group.
