Mr Warren:  I am always concerned about situations where you have multiple Acts which have to be considered.  The Emergency Management Service Act, the particular municipal Code, and the Sunshine Act may all be in play.  I don’t know of any provisions in either or all of those Acts that provides a definitive provision of which acts trump over another one.  I think, if used judiciously, the Emergency Services Act may give some "cover" to the municipality. My municipalities are addressing each issue by balancing the protection of the public against a possible violation of either the Open Records Act or the Sunshine Act.  We are erring on the side of caution.  The OOR is looking at the law in a vacuum; and, not considering the other laws that may come into play.  Les Mlakar

Dear Mr. Warren:  While the OOR’s earlier information provided a caveat which said: “Some agencies may be governed by laws which add requirements beyond those included in the Sunshine Act.”, the OOR and the individuals sending messages to the OOR are forgetting the caveat; and, also essentially ignoring the need to look at the provisions of the Emergency Management Services Act.
