Although an unpublished decision, it's nice to see a win for local government. This case reflects how a code enforcement case can tax the will of any city, county or public official. The case went through a myriad of proceedings, litigation and hearings only to be resolved each time in favor of the government. The case reflects how a prosecutor's office sometimes offers little support in pursuing a code violator finding the docket too busy to deal with multiple citations.
This latest case achieved a result similar to those the Plaintiff pursued previously but to add to the city's success, the court concluded that the District Court erred in denying the city's request for attorney's fees and remanded for further consideration. For code enforcement the case reflects the need to not give up and for civil rights litigators, it reflects a chance to recover attorneys' fees from a misguided Plaintiff.
