In anticipation of our call on Friday regarding the legal implications of the federal government sending national guard troops to cities, we wanted to pass along yesterday's decision in Newsom v. Trump<https://storage.courtlistener.com/recap/gov.uscourts.cand.450934/gov.uscourts.cand.450934.176.0_1.pdf>. As you have likely heard, after a bench trial, the district court judge concluded that the Defendants had violated the Posse Comitatus Act by using armed soldiers to engage in law enforcement activities in and around Los Angeles. The court enjoined the Defendants from deploying the National Guard in California to execute laws unless the Defendants can satisfy the requirements of a valid constitutional or statutory exception to the Posse Compilates Act. The order is stayed until 9/12/25. By way of background, the Posse Comitatus Act states that: Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army, the Navy, the Marine Corps, the Air Force, or the Space Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both. 10 U.S.C. § 1385.
