Dear IMLA Immigration Working Group:

I wanted to share a couple of items with you:

  1. I am providing a link to an article indicating that the federal administration officials have determined that the Alien Enemies Act of 1798 allows ICE to enter homes and other private areas without a warrant.  It is unclear if the administration will do this, but I know many of you have developed policies on private spaces and what types of warrants ICE would need to access those spaces so I wanted to share this: https://www.nytimes.com/2025/03/20/us/politics/trump-alien-enemies-immigration-agents.html?unlocked_article_code=1.5k4.UbaR.xh1FztZoemXC&smid=url-share.

  2. I am attaching a letter from the acting secretary of the administration for children and families indicating that ACF will be reviewing public benefit programs to ensure alignment with the Executive Order titled "Ending Taxpayer Subsidization of Open Borders".  Per the letter, ACF will work to ensure that programs "do not serve as an incentive to encourage illegal migration."
