Marina overcharges on repairs, refuses to honor estimate

F

Any suggestions on how to handle a marina that refuses to honor their
estimate.  I have had a marina in lower west Florida do about $ 30 K in  insurance
work which they finished exactly on the estimate.

The problem is that I had them do some additional work for me that was
estimated at about $ 3 K, but the final bill came in at over $ 6 K, and they had
provided me with written estimates, and NEVER advised of problems until  they
just sent me the final invoice, with no explanation.

They have refused to reduce the bill down to the estimate, and the
difference is about $ 3 K.  Their only excuse it "that is the time the job  took".....
and it is my feeling that I am being taken to the cleaners.  I  know what sort
of work they performed and there is no way that it took the  number of hours
(at $90 pr/hr) that they claim.

The problem, is that they have my boat, BUT I have not only the money I owe
them but I also have the insurance funds, none of which has been disbursed to
the marina.  I am now home in Michigan and the boat is down in lower
Florida.  I won't be at the boat till October at the earliest.

Does anyone know if I have any recourse on this problem?  Any  suggestions
would be appreciated.

Check into the states laws on estimates...many have a LAW that written
estimates cannot be exceeded by more than 10% without approval. Dont send
them ANY of the money until its resolved.

While I agree 100% with David on this not to send them any money, what happens if they start to charge you storage for the boat being there? Is this a possibility? Has anyone else here any insight into that end of this?

I personally don't think this is the proper forum, my thinking is this is a
"buy-sell-trade" forum, not air out your dirty laundry forum.

OK, so I picked the wrong list to reply to but the original was sent to this one and to several others, all of which I belong to.

My apologies to the list and I will crawl back into the hole from whence I came

After having been flamed by a few of the members of our group for my post  I
want to add that I applaud you for responding back. My intent was not one to
insult you, Robert, but to point out that it was becoming a dialog that
really has no solution over the Internet other than to gain knowledge, which
I'm sure was your intent. I know of several boards that I could go to and
make some popcorn and have a real evening of seeing nothing but "what do you
think about so and so or have you ever done such and such" and I am sure
they are all good boards.....for those who seek them out. I joined this
board  because of what it is, Buy, Sell, or Trade.

I apologize to those who feel I overstepped , and from now on I will try to
keep my passions within due bounds.
