Hi All,

So according to my lawyer we are very near a resolution on the objections
that have obstructed my PUC approval for OT Tours. Woop Woop!

However I still need to prepare for court incase the deal falls through.
For that I need to prove 'Public Need' and I can do that with at least 3
witnesses in every county I intend to operate. I am hoping I can fulfill
this requirement via the rugby team!

What exactly do I need? Well for the moment I just need your name, address,
email address and phone number. Hopefully that is all, but if it does go to
court then a handful of eye witnesses, so hopefully some of the people on
my witness list can attend the court date and say yes there is a need.
Totally ridiculous process but those are the rules... If it got to that
stage then I would be indebted to you, resulting in free red rocks, ski
days, airport rides etc

Below are notes from my lawyer that clarify the situation

  • The only way to establish public need is to have members of the public
as witnesses. It does not matter who those members of the public are as
long as they are adults. This means that you shouldn’t waste your time
looking for politicians or high-level business people to act as public
witnesses. Just regular members of the public are sufficient. Of course, if
you can get high-level business people or politicians, it certainly
wouldn’t hurt. Again, however, it’s not an absolute necessity.

  • My recommendation is to try to find two to three witnesses from each
county in which you’re going to operate.

  • When you’re putting together your list of witnesses, the more names
you put on, the better. Remember, your witness list is only going to have
proposed witnesses, meaning people who possibly can be witnesses. You may
end up putting 100 or 125 people on that list, but that doesn’t mean that
many are going to testify. Just get the names on the list, and then worry
about who will show up. But witnesses do flake out and fail to show up, so
you need to have as many people as possible on the list in anticipation of
    this happening.

Thanks everyone!
