The U.S. Supreme Court granted certiorari review of a regulatory taking case for the October 2016 term which is focused on the issue of how the court measures the property interest at issue in determining whether the impact of the governmental regulation triggers the requirement for compensation. The case involves a challenge to a lot merger ordinance that involuntarily merges substandard lots by operation of law with a commonly owned, contiguous lot so as to make one fully conforming lot. Regulatory takings expert and organizer of the annual Conference on Litigating Takings Challenges to Land Use and Environmental Regulations Professor John Echeverria wrote an amicus brief in the case on behalf of a group of economists to help the Court understand how regulatory restrictions affect the value of land and will discuss the case and its potential impacts on the law with land use webinar hosts Susan Trevarthen and Dan Mandelker.

John Echeverria
Professor of Law
Vermont Law School
John Echeverria is a Professor of Law at Vermont Law School where he teaches Property, Public Law and a wide range of environmental and natural resource law courses. Prior to joining the Vermont Law School faculty in 2009, he served for 12 years as Executive Director of the Georgetown Environmental Law & Policy Institute at Georgetown University Law Center. He also was General Counsel of the National Audubon Society and General Counsel and Conservation Director of American Rivers, Inc., and was an Associate for four years in the Washington, D.C. office of Hughes, Hubbard & Reed. He served for one year as law clerk to the Honorable Gerhard A. Gesell of the U.S. District Court for the District of Columbia immediately after graduating from law school.
Professor Echeverria has written several books and numerous scholarly articles on environmental and natural resource law topics. He has published pieces for more general audiences in The New York Times, The Washington Post, and The Christian Science Monitor. He has represented state and local governments, environmental organizations, and planning groups in a variety of legal matters at all levels of the federal and state court systems. In 2007, Professor Echeverria received the Jefferson Fordham Advocacy Award from the American Bar Association to recognize outstanding excellence within the area of state and local government law over a lifetime of achievement. In addition to teaching at Vermont Law School, he has served as a Visiting Professor at Harvard Law School and Georgetown University Law Center.
Professor Echeverria received a JD degree from the Yale Law School. He received a Master's degree from the Yale School of Forestry and Environmental Studies as well as a BA degree from Yale College (summa cum laude).

Susan Trevarthen ESQ., FAICP chairs the Municipal Land Use and Zoning practice and is a Member of the law firm of Weiss Serota Helfman Cole & Bierman, P.L. in Fort Lauderdale. She handles land use, planning and zoning matters for governments, and is Town Attorney for a Broward coastal community. Her work includes reviewing and negotiating development agreements and approvals, drafting municipal codes and plans, advising municipal staffs, managers and attorneys, defending challenges to municipal regulations and decisions, handling public hearings, and counseling elected officials, as well as advocating for municipalities on legislative issues in her field. Her practice also includes constitutional law issues (such as takings, Harris Act, and First Amendment-protected land uses including signs), public school facilities, and hot topics in zoning law. Ms. Trevarthen has been board certified in City, County and Local Government Law by the Florida Bar since 2003, has been recognized as one of the top land use attorneys in the state in publications such as Florida Trend Magazine and SuperLawyers, and is AV rated. She has also held leadership positions in the Florida Bar's Section for Environmental and Land Use Law and Section for City, County and Local Government Law. Susan grew up in Boca Raton, Florida. She was graduated from University of North Carolina at Chapel Hill with a joint degree in law and planning (M.R.P. and J.D., 1991) and from Duke University (A.B., 1986), and is a member of the College of Fellows of the American Institute of Certified Planners.

Daniel R. Mandelker, Stamper Professor of Law, Washington University in Saint Louis, is a leading scholar and teacher in land use law, environmental law, and state and local government law. He was the principal consultant and contributor to the American Planning Association's model planning and zoning legislation project. He was also the principal consultant to a joint American Bar Association committee that prepared a model law for land use procedures that was adopted by the ABA House of Delegates. He recently published a handbook on free speech law for on premise signs, a coauthored fourth edition of his APA report on Street Graphics and the Law, and a coauthored new edition of his law school casebook in State and Local Government. Additionally, he received the ABA's State and Local Government Section Daniel J. Curtin Lifetime Achievement Award.

Employee Discipline: Terminating the Walking Dead Employee
While some folks are gearing up for a day of candy hearts and romance, the rest of us are biting our nails and sitting on the edge of our seats waiting for AMC to roll out the latest Walking Dead episodes. Using this critically acclaimed dystopian zombie thriller as a backdrop, Ms. Moran walks attendees through several important tips for navigating the risky waters of employee discipline (no actual knowledge of the Walking Dead required).
The presentation will address a variety of legal issues that arise during the disciplinary process, including practical limitations on at-will employment and how to avoid discrimination and retaliation claims under Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act, and similar laws governing the employment relationship. The presentation will also look at the EEOC's guidance on employee discipline and termination and offer practical strategies to help navigate the high-risk process of separating employees.

Marilyn Moran is passionate about learning her clients' businesses from the ground up and working with management to solve problems and implement smart business solutions as efficiently as possible. Marilyn provides advice and training to employers on a wide variety of employment law issues, including discrimination, harassment, retaliation, wage and hour violations, non-competition agreements, executive compensation issues, and reductions in force. Marilyn is an active member of the Central Florida community. She frequently participates in client seminars, workshops, and conferences and enjoys mentoring students and giving back to the profession she loves through volunteering. In recent years, Marilyn has volunteered as a guest lecturer, moderator, or judge for the University of Central Florida, FAMU College of Law, Barry University's Dwayne O. Andreas School of Law, Eleventh Circuit Judicial Conference, American Bar Association, Federal Bar Association, and the Florida Bar.
Marilyn is a fifth generation Floridian who worked as an Assistant State Attorney in Sarasota, Florida following law school. She also served as a law clerk for the Honorable Gregory A. Presnell, U.S. District Court Judge for the Middle District of Florida. Prior to working at FordHarrison, Marilyn practiced employment law at one of the nation's largest law firms.
Roberta "Robin" Cross currently works as the Township Attorney for The Woodlands Township, Texas. She has over eighteen years' experience working for local governments and was recognized as an IMLA Fellow in 2013. She has also worked as in-house counsel for a police labor union and for the EEOC, as a trial attorney. She is licensed to practice in Texas and admitted all of its federal courts, the Fifth Circuit Court of Appeals and the U.S. Supreme Court. She has been Board-certified in Labor and Employment Law since 1992 by the Texas Board of Legal Specialization. She was appointed as Vice-President of IMLA's Personnel Section in the fall of 2015. She enjoys employment law, among other things, because "you can't make this stuff up."

The U.S. Supreme Court granted certiorari review of a regulatory taking case for the October 2016 term which is focused on the issue of how the court measures the property interest at issue in determining whether the impact of the governmental regulation triggers the requirement for compensation. The case involves a challenge to a lot merger ordinance that involuntarily merges substandard lots by operation of law with a commonly owned, contiguous lot so as to make one fully conforming lot. Regulatory takings expert and organizer of the annual Conference on Litigating Takings Challenges to Land Use and Environmental Regulations Professor John Echeverria wrote an amicus brief in the case on behalf of a group of economists to help the Court understand how regulatory restrictions affect the value of land and will discuss the case and its potential impacts on the law with land use webinar hosts Susan Trevarthen and Dan Mandelker.

Vermont Law School
John Echeverria is a Professor of Law at Vermont Law School where he teaches Property, Public Law and a wide range of environmental and natural resource law courses. Prior to joining the Vermont Law School faculty in 2009, he served for 12 years as Executive Director of the Georgetown Environmental Law & Policy Institute at Georgetown University Law Center. He also was General Counsel of the National Audubon Society and General Counsel and Conservation Director of American Rivers, Inc., and was an Associate for four years in the Washington, D.C. office of Hughes, Hubbard & Reed. He served for one year as law clerk to the Honorable Gerhard A. Gesell of the U.S. District Court for the District of Columbia immediately after graduating from law school.
Professor Echeverria has written several books and numerous scholarly articles on environmental and natural resource law topics. He has published pieces for more general audiences in The New York Times, The Washington Post, and The Christian Science Monitor. He has represented state and local governments, environmental organizations, and planning groups in a variety of legal matters at all levels of the federal and state court systems. In 2007, Professor Echeverria received the Jefferson Fordham Advocacy Award from the American Bar Association to recognize outstanding excellence within the area of state and local government law over a lifetime of achievement. In addition to teaching at Vermont Law School, he has served as a Visiting Professor at Harvard Law School and Georgetown University Law Center.
Professor Echeverria received a JD degree from the Yale Law School. He received a Master's degree from the Yale School of Forestry and Environmental Studies as well as a BA degree from Yale College (summa cum laude).

Susan Trevarthen ESQ., FAICP chairs the Municipal Land Use and Zoning practice and is a Member of the law firm of Weiss Serota Helfman Cole & Bierman, P.L. in Fort Lauderdale. She handles land use, planning and zoning matters for governments, and is Town Attorney for a Broward coastal community. Her work includes reviewing and negotiating development agreements and approvals, drafting municipal codes and plans, advising municipal staffs, managers and attorneys, defending challenges to municipal regulations and decisions, handling public hearings, and counseling elected officials, as well as advocating for municipalities on legislative issues in her field. Her practice also includes constitutional law issues (such as takings, Harris Act, and First Amendment-protected land uses including signs), public school facilities, and hot topics in zoning law. Ms. Trevarthen has been board certified in City, County and Local Government Law by the Florida Bar since 2003, has been recognized as one of the top land use attorneys in the state in publications such as Florida Trend Magazine and SuperLawyers, and is AV rated. She has also held leadership positions in the Florida Bar's Section for Environmental and Land Use Law and Section for City, County and Local Government Law. Susan grew up in Boca Raton, Florida. She was graduated from University of North Carolina at Chapel Hill with a joint degree in law and planning (M.R.P. and J.D., 1991) and from Duke University (A.B., 1986), and is a member of the College of Fellows of the American Institute of Certified Planners.

Daniel R. Mandelker, Stamper Professor of Law, Washington University in Saint Louis, is a leading scholar and teacher in land use law, environmental law, and state and local government law. He was the principal consultant and contributor to the American Planning Association's model planning and zoning legislation project. He was also the principal consultant to a joint American Bar Association committee that prepared a model law for land use procedures that was adopted by the ABA House of Delegates. He recently published a handbook on free speech law for on premise signs, a coauthored fourth edition of his APA report on Street Graphics and the Law, and a coauthored new edition of his law school casebook in State and Local Government. Additionally, he received the ABA's State and Local Government Section Daniel J. Curtin Lifetime Achievement Award.

Employee Discipline: Terminating the Walking Dead Employee
While some folks are gearing up for a day of candy hearts and romance, the rest of us are biting our nails and sitting on the edge of our seats waiting for AMC to roll out the latest Walking Dead episodes. Using this critically acclaimed dystopian zombie thriller as a backdrop, Ms. Moran walks attendees through several important tips for navigating the risky waters of employee discipline (no actual knowledge of the Walking Dead required).
The presentation will address a variety of legal issues that arise during the disciplinary process, including practical limitations on at-will employment and how to avoid discrimination and retaliation claims under Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act, and similar laws governing the employment relationship. The presentation will also look at the EEOC's guidance on employee discipline and termination and offer practical strategies to help navigate the high-risk process of separating employees.

Roberta "Robin" Cross currently works as the Township Attorney for The Woodlands Township, Texas. She has over eighteen years' experience working for local governments and was recognized as an IMLA Fellow in 2013. She has also worked as in-house counsel for a police labor union and for the EEOC, as a trial attorney. She is licensed to practice in Texas and admitted all of its federal courts, the Fifth Circuit Court of Appeals and the U.S. Supreme Court. She has been Board-certified in Labor and Employment Law since 1992 by the Texas Board of Legal Specialization. She was appointed as Vice-President of IMLA's Personnel Section in the fall of 2015. She enjoys employment law, among other things, because "you can't make this stuff up."

CLE Corner
Applying for CLE Credits
1. The attorney must participate in the entire distance learning event, including the Q&A.
2. During the distance learning event, the moderator will announce a four-digit CLE "code" that attendees will need to write down and include on the certificate of attendance form. (Step 5, below, outlines how to receive the certificate of attendance form).
3. If you are participating in a group setting and are requesting CLE, please print off the Attendance Record-Sign-In/Sign-Out Sheet<http://r20.rs6.net/tn.jsp?f=001lw7vXOM0Oi8Vb3I9k_Qx0UKwBvggujxl9iI5sk7mKQIcHnXvCgD7TCTQ1AWFuJJIEHZWpxUscYxYBXHs-hsYrDMgjUipIW1KH2PMHT_r7NuCzF9p9pWNwUqcpFvmmpKN5smn8dL8ZNPA4W_tDi43jGuASUq8lC5gUoP-JzsR_cG_EtCnqjTdDAxZbKaVlez3Z0LVaH89mKQfm3zuix9BR0B6lqoFyUvk04oX8ujyvnBALhDt_IkrXg==&c=vLl96L2EnGIbG7kWKG4zTySHZ4ZGVHIRBpj-foGT_zPSJD9LAJXnVQ==&ch=tTbJ1acfVYYCmFrwKlAFO2wNFBd78TNUp6sT0ShTJd2TVjcMAcoFrg==> and complete and return it to IMLA via e-mail (cle@imla.org<mailto:cle@imla.org>) within 30 minutes of the end of the distance learning event. 4. Attorneys must complete an online evaluation after the conclusion of the call. The online evaluation is given above.
5. Once you finish the online evaluation and hit "done," you will AUTOMATICALLY be forwarded to the Certificate of Attendance form. (If you are not, please contact IMLA at cle@imla.org<mailto:cle@imla.org>).
6. The certificate of attendance form must be completed, signed, and sent back to IMLA (e-mail to cle@imla.org<mailto:cle@imla.org> ).
7. If you have requested MCLE to be filed by IMLA, IMLA will make application to the MCLE state bar requested on your CLE Request Form; upon conclusion of the distance learning event IMLA will return the individual signed certificate of attendance to the attorney within 30 days of credit approval from the state agency.
IMPORTANT!
Our distance learning events are a quick and convenient way to earn CLE credits. CLE credits are available for an additional cost per person in states where distance learning event CLE is accredited. States currently not accredited for IMLA distance learning events DE. If you are applying for CLE, there is a new filing process in order to receive CLE credit.
