Having spent the last two months pouring over state orders, I doubt very much that there’s any intention to alter the conditional use limitation you describe. But I invite others to weigh in. I’ve been wrong before.

I would be interested in anyone’s input on the Governor’s order effective June 5 that permits outdoor dining in phase yellow counties. I represent a Township that only allows outdoor dining by conditional use. Does/can the order trump local zoning, or is it to be read to mean, “at those restaurants that previously provided outdoor dining”?

Any input appreciated.

I don't think the Governor's Order can override the Zoning Ordinance.  Of
course, the Municipality could turn a "blind-eye" to the violations and
issue a Notice to the Facilities that the outdoor dining is only during the
period the Municipality is in the "yellow phase" and when the "green phase"
becomes effective the facility is required to cease the outdoor dining.  If
an individual files a complaint alleging a violation, the municipality
would be required to enforce its Zoning Ordinance.  Les Mlakar
