The zoning officer denied an application for a drug rehab center and the applicant appealed to the zoning hearing board. At the hearing the Applicant presented two expert witness. The Town requested leave to determine whether it should call experts at the next zoning hearing board meeting. The request was denied. The Town appealed to the Court of Common Pleas raising a number of issues including a request for a remand. The request for remand was granted. Along with the appeal the Town filed a motion to stay as provided for in the Municipalities Planning Code. A hearing is scheduled on the Petition for Stay. The question is whether the remand makes the Petition for Stay moot. I would appreciate your thoughts and thank you. Jack John A.
