A bird that gets aspergillosis or is exposed to aflatoxin (produced by aspergillus) may get very sick or die. Most common effects are liver disorders (including cancer), blood disorders, and suppression of the immune system. A post-mortem study of yard birds in Britain showed high levels of aflatoxin in some birds.

They have caused huge die-offs of honeybees in Europe and provoked an uproar among scientists, not least because the studies that purported to establish their safety were financed by pesticide manufacturers.

If they can not support their claims why do we fear their threat of law suit. If it does what they say, prove it with competent data and we will go away and/or support their product. If it does not, screw em. But, do not be afraid to challenge their bogus claims which are/can not be supported by competent data.
